BigByts enables delivery of orders placed on the platform (BigByts Mobile Application). Deliveries of the Order are done by using third party ("Delivery Services") by connecting third party service providers i.e., pick-up and delivery partners (“PDP”) who will be responsible for providing the pick-up and delivery services and completing Tasks initiated by the users of the Platform (“Customers”).

The Platform Services and Delivery Services are collectively referred to as "Services". For both Platform Services and Delivery Services, BigByts is acting as an intermediary between the Users/Buyers/Customers and/or PDPs and Restaurants.
PDPs are individuals engaged via a Third-Party Agency for BigByts. PDPs are Employees and on pay-roll of the Third-Party Agency.

For the pickup and delivery services and completing the Tasks, BigByts may charge the users of the Platform, delivery fees determined based on various factors including but not limited to distance covered, time taken, demand for delivery services/Tasks, real time analysis of traffic and weather conditions, seasonal peaks or such other parameters as may be determined from time to time.

Upon Acceptance/Assignment of any Order or Task to the PDPs, the pickup and delivery services or Task completion services (as the case may be) undertaken by him/her, is part of its full-time services as per contract between Third-Party Agency and BigByts.

BigByts shall not be responsible for the services provided by PDP to Buyers/Users/Customers through the Platform.

BigByts may, however, offer support services to PDPs with the limited App Usability for Order fulfilment, Delivery Call centre support, and other services.

BigByts accepts no liability for any errors or omissions, whether on behalf of itself or third parties. BigByts does not make any representation or warranty with respect to any aspect of the services being provided by the PDPs through the Platform including but not limited to pick up and delivery services and Task completion services to the Buyers/Customers/Users as the case may be.

BigByts is not responsible for any non-performance or breach of any contract entered between PDP and the Third-Party agency for BigByts. BigByts is not responsible for unsatisfactory or non-performance of services or damages or delays and have limited responsibility towards the User/Customers/Buyers limited to BigByts Credits/Coupons.

BigByts is operating an online marketplace and assumes the role of facilitator and does not at any point of time come into or take possession of any of the products offered by Restaurant or PDP. In case of complaints from the Buyer pertaining to efficacy, quality, or any other such issues, BigByts shall notify the same to Restaurant and PDP and come to a reasonable solution considering the nature of the issue. In the event you raise any complaint on any item/delivery ordered/delivered from using our Platform, we shall assist you to the best of our abilities by providing relevant information to you, to enable satisfactory resolution of the complaint.

In no event shall BigByts Be responsible for any acts or omission or commission prejudicial to the interest of the user and shall not be liable for any claims of any nature whatsoever. PDP undertake to comply with all laws and regulations as applicable including KYC details, as may be directed, from time to time. By usage or access to this marketplace, user accepts all terms and conditions. BigByts reserves it’s right to change, amend, alter, delete any of the terms and conditions at its discretion.
